Ask Armenian Ombudsman about discrimination of LGBT people in Armenia, homophobia, inequality, other human rights violations

URGENT!

Thanks to A1+ blog, we have an opportunity to ask direct questions to the Human Rights Defender (Ombudsman) of Armenia Armen Harutyunyan.

I think it’s a good opportunity to ask (perhaps for the first time) Armenian official who is responsible for the human rights protection in our country about the state with LGBT people in Armenia, gay rights, homophobia, inequality, discrimination, lack of legal protection. You may wish to ask also specific, more personal questions, if appropriate, which involve human rights violations and discrimination.

Just submitted my question to Armenian Ombudsman:

Dear Mr Harutyunyan,

As stated in your website, the Human Rights Defender of Armenia aims at “rais[ing] the country’s level of legal and juridical protection of the people” and “creation of state guarantees, and mechanisms for their enforcement”.

Gay men and women in Armenia are subject to routine homophobia and discrimination in their everyday life (workplace, schools etc) and overwhelmingly forced to hide their sexual orientation in order to integrate into society. As stated in a recent United Nations High Commissioner for Refugees (UNHCR) review of gay rights in Armenia, till now “Armenia[n] legislation does not contain a single provision on discrimination based on or due to sexual orientation”.

I wonder how Armenian Ombudsman intends to incorporate gay rights into the agenda of the Human Rights Defender of Republic of Armenia and when can we expect an introduction of comprehensive legal ban on discrimination (similar to anti-racist laws), including grounds of sexual orientation.

Micha Meroujean of AGLA France (I still can't speak of AGLA France in past tense!) also submitted his questions raising similar issues of discrimination and legal protection of rights for LGBT Armenians. Particularly, he asked whether Ombudsman plans to propose any specific anti-discriminatory measures (on the grounds of sexual orientation) to the Armenian parliament. Also, whether we could expect a legislation which (similarly to racism) would condemn homophobia too. ("When Armenia will outlaw homophobia or hate propaganda against LGBT people?"). And finally, Micha asks about Ombudsman's position to introduce anti-hate measures in educational system in Armenia.

More LGBT-related questions have been submitted to the Ombudsman.

M.H. stresses difficulties faced by NGOs working on LGBT-related issues in Armenia - obstacles from government and law enforcement agencies. M.H. also pointed out discrimination and violence faced by LGBT people in Armenia.

Dear Mr. Harutyunyan,
I would like to ask you what is being done, concretely, to address the issue of LGBT (Lesbian, Gay, Bisexual and Transgendered) rights in Armenia. All of the stories, anecdotal or otherwise, that one hears about the experiences of gay and lesbian people in Armenia are rather negative, which does not reflect well on the Republic of Armenia and Artsakh.
As a member of the Council of Europe, Armenia is sworn to follow and uphold human rights legislation that, in this case at least, it is paying only lip service to.
As a people that has known discrimination thoughout its history, it would behoove us to respect the rights of all Armenian citizens and celebrate and promote the existence of a vibrant gay and lesbian community in Armenia.

There was a similar thing with Putin when i was living in Russia. My flatmates and i voted for the gay question to be asked...guess what questions got the most votes?
What did he think of 'Medved' (ie the cartoon bear) and why did he kiss the little boy's stomach?
i'm sure there are some extremely unimportant questions flying about in Armenia too...

:) Luckily, in this case there is no voting to select questions, and we were promised that Ombudsman will answer all our questions. I hope it will be the case. In any, case, am keeping an eye on it and will follow the situation.

...and here is reply to our questions by Armen Harutyunyan, the Human Rights Defender (Ombudsman) of Armenia. I am sorry, do not have time to translate (below is Armenian version). It is very important and indicative. Basically what he is saying is that homophobia is not a problem in our society, there are no complaints, that homophobia is outlawed by Armenian legislature (???!!! - I'd love him to refer to any specific article in Armenian law) etc. etc.

I wish what he said is the real picture of Armenia... May be we also are to blame - no complain - no problem. Probably, this was the first time that he got questioned about the state with gay people, discrimination and homophobia in Armenia. I hope Armenian LGBT organisations (WFCE, Pink Armenia) will take a note of
his remarks and will act on them.

Anyway, due to shortage of time, posting his answer (in Armenian) here. Will make a special blog post on this upon returning from holiday.

(Միշա Մերուժան (AGLA նախագահ), Միկա (Gay Armenia blog-ի հեղինակ), Քրիստոֆեր Ատամյան (New York CIiy), Մ.Հ.) -Ոչ մեկի համար գաղտնիք չէ, որ միասեռականների դրությունը Հայստանում չափազանց վատ է եւ շատերն են բռնության ենթարկում, փողոցում, աշխատանքի վայրում, բանակում: Մարդկանց մեջ թյուր կարծիք է ձեւավորվել, թե երեւույթը առաջ է եկել Եվրոխորհուրդի հետքերով, իբր դա հիվանդություն է: Ըստ օրենքի` ոչ մի խնդիր չունեն միասեռականները, բայց անկախ օրենքից ենթարկվում են հալածանքների, արհամարհանքի նաեւ բռնության հենց կառավարության կամ “օրենքի պաշտպանների” կողմից:

Sterile replies from a nomenklatura aparatchik. If you listen to him. Armenia is a gay heaven. No complaints means no problems. And when "problem chka" as he said then no need for law. Cool! I would have been surprised ... if he said smth different.
